Introduction

This privacy policy explains how we collect, use, store and protect your personal data when you use our website and our cybersecurity, cloud and IT support services.

Information We Collect

  • Personal information: we collect your name, email address and the content of your message when you send us a request through the website’s contact form.
  • Technical information: when the contact form is submitted, minimal technical data necessary for anti-spam verification and security is processed (for example, the IP address and browser signals).
  • Cookies: the website does not use tracking cookies or third-party analytics services, and does not create user profiles.

Source of Personal Data

  • The Controller processes personal data obtained with consent, collected through the website’s contact form.
  • The Controller only processes the identification and contact data necessary to respond to your request.
  • Personal data will not be made public and will not be sold to third parties.

Purpose of Data Processing

The Controller processes personal data for the following purposes:

  • To respond to the request submitted through the contact form (name, email, message) and, where applicable, to send you the requested offer.
  • To comply with applicable legal obligations.

The legal basis for processing is your consent (Art. 6(1)(a) GDPR), expressed by ticking the box when submitting the form, and respectively our legitimate interest in responding to a request you address to us (Art. 6(1)(f) GDPR).

How We Further Use the Information

  • Providing and improving services: we use the information collected to respond to requests and to improve our cybersecurity, cloud and IT support services.
  • Security: we use technical information to protect the security of the website and services against unauthorised access and other cyber threats.

Retention Period of Personal Data

  • Messages sent through the contact form are kept for the period necessary to resolve the request and, subsequently, for no more than 12 months, after which they are deleted or anonymised.
  • Data that we are legally required to retain is stored for the period provided for by the applicable regulations.

Recipients of Personal Data and Processors Engaged by the Controller

We do not sell, rent or share your data with third parties for marketing purposes. Contact form data is transmitted and stored on Braincap’s own infrastructure.

Processors engaged by the Controller:

  • Cloudflare, Inc. — provides the Turnstile anti-spam protection service for the contact form. When the form is submitted, Cloudflare processes minimal technical data necessary for verification (for example, the IP address and browser signals). Turnstile does not use tracking cookies and does not create advertising profiles.

Your Rights

In accordance with the Regulation, you have:

  • The right of access to personal data.
  • The right to rectify personal data.
  • The right to erase personal data.
  • The right to object to the processing of personal data.
  • The right to restriction of processing and the right to data portability.
  • The right to withdraw your consent at any time, in writing or by email to: [email protected], without affecting the lawfulness of processing carried out prior to withdrawal.
  • The right to lodge a complaint with the Romanian Data Protection Authority (ANSPDCP).

Security of Personal Data

  • The Controller declares that it has taken all necessary technical and organisational measures for the protection of personal data.
  • We implement appropriate technical and organisational security measures to protect your personal information against loss, unauthorised use, unauthorised access, disclosure, alteration or destruction.

Changes to the Privacy Policy

We reserve the right to update this privacy policy at any time. Any changes will be published on this page.

Final Provisions

  • By submitting a request through the contact form on www.braincap.ro, you confirm that you have been informed of the personal data protection conditions and that you accept them.
  • You express your agreement by ticking the consent box within the contact form.
  • The Controller may update these rules at any time. The new, updated version is published on the website.
